Terms and Conditions (TC) for Microcar Rental

Effective Date: July 1, 2025

These Terms and Conditions (hereinafter referred to as "TC") govern the contractual relationship between the Microcar Rental Company (hereinafter referred to as "the Lessor") and the renter of a microcar (hereinafter referred to as "the Renter"). By renting a microcar from the Lessor, the Renter agrees to be bound by these TC.

1. Parties to the Agreement

Lessor: Daniel Dominic Maag & Fabiana Sociale Pires (The AmiGo), Kanalpromenade 60, 3800 Interlaken, Canton of Bern, Switzerland
Renter: Any natural person or legal entity entering into a rental agreement with the Lessor for a microcar.

2. Rental Agreement and Vehicle Handover

2.1. The rental agreement is concluded upon confirmation of the booking by the Lessor and payment of the agreed rental fee by the Renter.

2.2. The Renter acknowledges that the rented microcar is specifically designed for urban and regional use, with a maximum speed of 45 km/h and a limited estimated battery range of approximately 75 km under optimal conditions.

2.3. The Renter understands and accepts that the microcar may not be delivered with a full battery range at the time of handover, due to logistics, delivery procedures, and prior usage. The Lessor will inform the Renter of the approximate remaining battery charge at handover.

2.4. The Renter is responsible for inspecting the vehicle for any existing damage before commencing the rental period and must report any discrepancies immediately to the Lessor. Failure to do so will result in the Renter being deemed to have accepted the vehicle in its current condition.

2.5. Handover and Return Schedule: Pick-up is at 09:00, with arrival by 08:45 for vehicle inspection, instructions, and security deposit processing. Return is fixed at 17:00, regardless of the actual pick-up time. These times are strictly fixed under agreement. The Renter must inform the Lessor immediately in case of delay. If the Renter wants to arrange an earlier or later pick-up or return, they must contact the Lessor in advance and obtain written confirmation. The Lessor is not present at the handover point outside agreed hours. If the Renter does not arrive within 15 minutes after the scheduled pick-up time, the booking is considered a no-show without refund. Delayed returns remain subject to the agreed return time and may incur a late fee of CHF 50.- per hour.

3. Renter's Obligations and Vehicle Use

3.1. Driver's License: The Renter must possess a valid driver's license that is recognized in Switzerland and legally permits the operation of the rented microcar. The Renter is solely responsible for ensuring the validity and appropriateness of their driver's license throughout the rental period. Official details can be found here.

3.2. Road Restrictions:
a. The Renter is expressly not permitted to operate the microcar on highways (Autobahnen / Autorouten, green road signs in Switzerland). This restriction is due to the microcar's limited speed and safety considerations.
b. The Lessor strongly discourages the use of the microcar on roads with a speed limit above 60 km/h, as its maximum speed of 45 km/h may cause significant traffic impedance and safety risks for both the Renter and other road users. The Renter assumes full responsibility for any consequences arising from operating the vehicle on such roads.

3.3. Battery Management and Costs:
a. The Renter is responsible for monitoring the battery charge during the rental period.
b. The microcar can be charged at standard electric car charging stations using an adapter or by using the normal household cable and plug provided with the vehicle. The Renter is responsible for any costs incurred for charging.
c. In the event that the Renter runs out of battery charge during the rental period and the vehicle requires towing, the Renter shall bear all costs associated with towing and any related recovery services.
d. The Renter must return the microcar with at least 5 km of remaining range. If the vehicle is returned with less than 5 km of range and cannot be moved safely, towing and any related costs will be charged to the Renter.

3.4. Vehicle Cleanliness: The Renter is expected to return the microcar in a reasonably clean condition, comparable to its state at the time of pick-up. While normal wear and tear dirt is acceptable, any excessive dirtiness, including but not limited to spills, stains, pet hair, or trash, that requires special cleaning will incur a cleaning fee of CHF 75.00.

3.5. General Responsibility: The Renter is responsible for the proper use and care of the vehicle during the rental period. This includes, but is not limited to, securing the vehicle (always secure with handbrake when parked), preventing theft (locking both doors, closing windows), and adhering to all applicable traffic laws and regulations in Switzerland.

3.6. Fines and Penalties: The Renter is solely responsible for all fines, penalties, and legal consequences arising from traffic violations or any other breach of Swiss law during the rental period. The Lessor reserves the right to charge an administrative fee of CHF 50.00 for processing such violations.

3.7. Personal Belongings: The Lessor shall not be responsible for the loss, theft, or damage of any personal belongings left in the microcar. Such items are not covered by the Lessor’s insurance.

4. Damage, Accidents, and Loss

4.1. Deductible for Damage: In the event of any damage to the rented microcar during the rental period, regardless of fault, the Renter is responsible for covering the deductible amount as specified in the rental agreement. A pre-authorization of CHF 500.00 will be placed on the Renter's credit card or other agreed-upon payment method to cover this deductible. The cost of any repair will be calculated based on local market rates for parts and labor, and documented by an invoice or repair estimate. The total charge will not exceed the deductible amount.

4.2. Reporting Accidents/Damage: The Renter must immediately report any accident, damage, theft, or loss involving the microcar to the Lessor and, if applicable, to the local police. The Renter must provide all necessary information and cooperate fully with the Lessor and authorities in the investigation of such incidents. Any damage to the vehicle not immediately reported to the Lessor as per this clause may incur an additional administrative fee of CHF 50.00 in addition to the repair costs and deductible.

4.3. Liability: The Renter is liable for all damages caused to the microcar due to their negligence, wilful misconduct, or violation of these TC, up to the full value of the vehicle, exceeding the deductible. The Renter is also liable for any third-party damages caused by their use of the microcar, to the extent not covered by the Lessor's insurance. The Lessor's insurance does not cover personal injury to the Renter or any passengers in the microcar. The Renter is solely responsible for ensuring adequate personal insurance coverage for themselves and any passengers during the rental period.

4.4. Mechanical Defects: The Renter shall not be liable for mechanical defects of the microcar caused by normal wear and tear. However, the Renter shall be liable for any mechanical damage resulting from intentional misuse, negligence, or improper handling of the vehicle.

5. Cancellation Policy

5.1. Free Cancellation: The Renter may cancel their booking free of charge up to 72 hours (3 days) before the scheduled rental start time.

5.2. Partial Refund: If the Renter cancels between 24 hours and 72 hours before the scheduled rental start time, a 50% refund of the total rental fee will be issued.

5.3. No Refund: If the Renter cancels less than 24 hours before the scheduled rental start time, or in case of a no-show, no refund will be issued.

5.4. Changes to Booking: Any requests for changes to a confirmed booking (e.g., date, duration) are subject to availability and may incur additional charges or a re-calculation of the rental fee.

6. Data Protection (Switzerland - nLPD)

6.1. The Lessor complies with the provisions of the new Federal Act on Data Protection (nLPD) (SR 235.1), which came into force on September 1, 2023, and its associated ordinances. 

6.2. Collection and Use of Data: The Lessor collects and processes personal data of the Renter (e.g., name, address, contact details, driver's license information, payment details) solely for the purpose of fulfilling the rental agreement, managing the vehicle fleet, processing payments, ensuring safety, and complying with legal obligations. 

6.3. Data Security: The Lessor implements appropriate technical and organizational measures to protect the Renter's personal data against unauthorized access, loss, misuse, or alteration. 

6.4. Disclosure to Third Parties: Personal data may be disclosed to third parties only if necessary for the execution of the rental agreement (e.g., payment service providers, insurance companies, towing services), or if legally required (e.g., law enforcement agencies in case of traffic violations or accidents). Data will not be sold or shared for marketing purposes without explicit consent. 

6.5. Renter's Rights: The Renter has the right to access, rectify, or erase their personal data held by the Lessor, as well as the right to restrict or object to its processing, to the extent permitted by law. Requests regarding data protection should be directed to the Lessor using the contact information provided.

7. Termination of Rental Agreement

7.1. The rental agreement may be terminated immediately by the Lessor without prior notice if the Renter: 

a. Provides false or misleading information during the booking process or at any point during the rental. 

b. Is in default of payment or if the provided credit card is invalid or uncovered. 

c. Violates any of the material terms and conditions outlined in this agreement. 

7.2. Upon termination of the rental agreement, the Renter is obligated to immediately return the microcar to the Lessor. The Lessor reserves the right to take possession of the vehicle, even if it is on private grounds, and any associated costs incurred for recovery will be debited to the Renter.

8. Governing Law and Jurisdiction

8.1. These TC and all disputes arising out of or in connection with the rental agreement shall be governed by and construed in accordance with the laws of Switzerland, excluding its conflict of law provisions. 

8.2. The exclusive place of jurisdiction for all disputes arising from or in connection with these TC and the rental agreement shall be the competent courts in Interlaken, Canton of Bern, Switzerland.

9. Miscellaneous

9.1. Severability Clause: Should any provision of these TC be deemed invalid or unenforceable, the validity of the remaining provisions shall not be affected. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that most closely reflects the original intent. 

9.2. Amendments: The Lessor reserves the right to amend these TC at any time. Any changes will be communicated to the Renter and will apply to future bookings. 

9.3. Force Majeure: The Lessor shall not be liable for any failure or delay in performance under these TC due to circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, epidemics, pandemics, natural disasters, or government actions.

By proceeding with the rental of a microcar, the Renter confirms having read, understood, and agreed to these Terms and Conditions.
